Cross-border transfers of data

Eduardo Ustaran is one of the world's leading authorities on the lawfulness of cross border transfers.  If you need advice on the use of model contract clauses for data exports, the adoption of Binding Corporate Rules, the use of Safe Harbor, the effect of the EU White List of approved countries or the exemptions from the general prohibition of transborder data flows to countries outside of Europe, Eduardo's your man.  He's advised some of the world's biggest brands on the international movement of data, representing their interests in negotiations with national governments and regulators.

Data security

Stewart Room is one of the most experienced data security lawyers around.  Adopting a holistic approach to the security risks within the information lifecycle, his approach extends beyond the pure data protection and privacy issues within information security to encompass the entire legal and risk framework within which the safety and security of information is dependent.  Post security breach Stewart advises organisations on their reporting obligations and represents their interests in dealings with the regulators. 

Interception and communications privacy

Stewart is heavily engaged in communications privacy issues such as interception of communications, the monitoring of communications and the retention of communications data, with a particular focus on the law enforcement and employment law aspects.  Stewart has specialist knowledge of the Regulation of Investigatory Powers Act and associated legislation.

Litigation and dispute resolution

Stewart's litigation and dispute resolution practice is closely linked to his data security practice.  Recent cases include defending a leading highstreet retailer in regulatory proceedings brought by the Information Commissioner following the loss of a laptop computer and the successful defence of private investigators in a criminal prosecution brought by the Commissioner for "data theft" from a government department.  He also acts for data subjects and data controllers in ligitation concerning the exercise of the data subject rights, such as the right of access to data.
